Shizuka: Quiet Home Screen — Terms of Use

These Terms of Use ("Terms") set out the conditions for using the iOS application "Shizuka: Quiet Home Screen" (the "App"). Anyone who uses the App (the "User") should use it only after agreeing to these Terms.

1. Scope

These Terms apply to every aspect of your use of the App. By downloading or using the App, you are deemed to have agreed to these Terms.

The App is distributed through the App Store. If Apple's terms differ from these Terms, Apple's terms take precedence as to the use of the App itself.

2. What the App provides

The App shows the names of apps you choose as a list in a widget on your Home Screen. It also provides a feature that makes the apps you choose unavailable for a set time (Focus), a feature that adds one 10-second breath before an app opens (Breathe), and a review of how you use your phone (Review: 7 days and 4 weeks).

The App does not send the apps you place on your Home Screen, your Screen Time information, or the usage records shown in Review off your device. We run no server and collect no information about you. The only communication the App makes is with Apple's App Store, for purchasing the full version and restoring purchases.

For details on how data is handled, please read the Privacy Policy we publish alongside these Terms.

3. Screen Time features

"Focus" uses the Screen Time framework that Apple provides in iOS to make the apps you choose unavailable. Using it requires your own permission.

The App is for you to use on your own device, for yourself. It is not designed for a parent to manage a child's device, or to manage anyone else's device.

You can lift the restriction on apps at any time from inside the App.

Breathe works by calling the App from an Automation in the Shortcuts app. You either import a shortcut that we prepared or create the Automation yourself, and you manage the Automation yourself.

4. The full version

In addition to what you can use for free, the App offers a full version that adds more features. Apps on your Home Screen, Breathe (for one app), Focus, and Review (7 days and 4 weeks) are in the free version. Every feature that uses Screen Time (Focus and Review) is free, with no limit on how often you use it. The full version adds 8 themes. It also removes the limit on the number of apps for Breathe.

The full version is a one-time purchase. You pay once and need no further payment to keep using it. Features we later add to the full version, and updates to its features, are also available to you at no additional payment. Whether and when we add features is up to us, and we do not promise any particular future feature. The price is the price shown on the purchase screen (taxes included where applicable). There is no automatic billing. The full version (one-time purchase) supports Family Sharing, so members of your Family Sharing group can use it too. The trial is not shared.

Before buying, you can try the full version free for 14 days (the "Trial"). You obtain the Trial from the App Store as a 0-yen product, so there is no payment. It ends automatically after 14 days. When the Trial ends, it does not switch to the full version, and you are not charged. The Trial can be used only once per Apple Account.

When the Trial ends, your theme returns to "Indigo". The theme you chose and similar settings stay on your device and are not deleted. Apps for Breathe beyond the free limit are paused, not deleted, and work again as before if you buy the full version.

Apple handles all payments and refunds. We do not receive or keep payment details such as your credit card number. If you want a refund, please contact Apple.

You can restore your purchase with "Restore purchases" using the same Apple Account, including after you change devices.

The App checks its purchase record by communicating with the App Store. If the record cannot be checked for 7 days after the last successful check, the App temporarily returns to the free version. It returns to the full version when you open the App somewhere with a connection, or when you use "Restore purchases".

5. Prohibited conduct

When using the App, you must not:

6. Disclaimer and liability

The App is provided "as is". We do not guarantee that the App is fit for any particular purpose of yours. However, if the full version does not work as described, we will work to fix it. This paragraph does not limit the provisions on damages in the paragraphs that follow.

If you suffer damage because of a cause attributable to us in connection with the App, we will compensate you for that damage.

If the damage in the previous paragraph results from our negligence (other than gross negligence), our liability is limited to the greater of the total amount you paid for the App up to the time the damage occurred (the price of the full version paid through the App Store) and 10,000 yen. This limit does not apply to damage to your life or body. It also does not apply to damage caused by our intentional misconduct or gross negligence.

The App is not intended for medical use or treatment. We do not promise that using the App will produce any particular effect.

The Home Screen widget, Focus, and Breathe run on top of iOS widgets, Screen Time, and Shortcuts. Depending on the state or updates of iOS, the widget may update late, the apps you chose may not be blocked as scheduled, or blocked apps may not become available again at the scheduled time. When we notice such behavior, we will work to fix it.

We may change the content of the App or end its provision. When we end it, we will announce it in the App or on this page at least 30 days before the end date, except where that is unavoidable. Even if distribution ends, the installed App will keep the features of the full version you have already purchased. Compensation for damage caused by a change or ending follows the provisions of this section.

7. Changes to these Terms

We may change these Terms in accordance with applicable law, including the provisions of the Japanese Civil Code on changing standard terms (Article 548-4). When we do, we will announce the new content and the date it takes effect on this page before that date. When we change the Terms, we update the last-updated date at the end of this page.

8. Governing law and jurisdiction

These Terms are governed by and interpreted under the laws of Japan.

If a dispute arises between us and you in connection with the App, the courts of Japan are the exclusive court of first instance by agreement.

Nothing in these Terms limits the rights that the consumer-protection laws of the country where you live give you. If those laws give you rights that cannot be waived by contract, or give you the right to bring a case in the courts of your own country, those rights apply regardless of the paragraphs above.
